The Chinese Congress decided on 30 August to amend the Trademark Law the third time since its introduction in 1982. The revised Trademark Law aims to stem problems like cumbersome trademark registration rules, excessively long time in affirming trademark rights and repeated malicious trademark infringement acts which cannot be curbed.

The Law provides greater convenience to applicants in lodging trademark registration, support market order to offer a level playing field and strengthen efforts to contain trademark infringement activities. Processing period for trademark registration specified.

China has ranked first worldwide in the volume of trademark registration applications, but its ability in processing such applications has lagged behind all along. The trademark processing cycle in China has once reached over three years, arousing great public concern. While the Trademark Office of the State Administration for Industry and Commerce has embarked on a number of interim measures in raising processing efficiency and shortening considerably the processing cycle, existing laws and regulations do not specify a time limit for processing trademark registration.
