for Steven Lam and abel: China import duty for edible birds nest (HS 04100010) is levied at 25% plus VAT 17%. Such import duty may be reduced for imports from Philippines and Malaysia under the China and ASEAN Free Trade Agreement provided that the criteria of the place of origin is fulfilled. Certificates of inspection and quarantine for imports of such goods are required.

Please refer to >>”“Topic: Import Tax + VAT Author twinpanda posted 12 March 2009 11:19 AM I have a chinese client who would like to purchase bird's nest from me in bulk quantity. My questions are: 1) With Product Origin certificate from Indonesia, will my bird's nests still be subjected to import tax if it is imported directly from Indonesia? 2) In order to sell to local chinese wholesale, do i have to set up a company in China? Or will a Hong Kong-based company be sufficient to conduct the transaction in China? Please advice. Thank you Author Moderator posted 03 April 2009 11:23 AM 1) Under the auspices of the China and ASEAN Free Trade Agreement import of birds nest classified under HS 04100010 originated from Indonesia (or Thailand – for the twinpanda above) is free of customs duty. 2) You can conduct this business through a company either in Hong Kong or China or directly through Indonesia”” I am new supplier of bird’s nest from Indonesia, wanted to export 30kg bird’s nest directly to my client at china through DHL. My questions are a)Refer to twinpanda “China and ASEAN Free Trade Agreement import of bird’s nest originated from Indonesia is free of customs duty?” Free of customs duty it mean free of export tax and import tax?? b)Criteria of the place of origin is fulfilled is it called Product Origin certificate?? c)Sanitary certificate of animal products from Agency for agricultural quarantine is it called Certificates of quarantine? d)So Just With Product Origin certificate, Certificates of inspection, Certificates of quarantine from Indonesia, can enjoy this free of customs duty “under China customs duty for birds next is 25% plus 17% VAT” Thank you

China import duty of edible birds nest classified under HS 04100010 is most likely to be reduced to even zero rate from some countries of the ASEAN under the auspice of the China and ASEAN Free Trade Agreement effective from January 2010. While the rate of the reduced tariff has yet been confirmed officially, the VAT 17% will still be maintained.

Understand that bird's nest import is subject to inspection and quarantine. What kind of test report do we need to produce? Avian-influenza and or micro reports?

for Judy: China implements a quarantine access system on imported food. Only those foodstuffs that meet reqauirements can enter China. Before an imported food operator or its agent imports any food products, an application should be made to the designated inspection and quarantine authorities for food label examination and approval. When the food product is imported, the imported and Expored Food Label Approval Certificate will be presented to the entry-exit inspection and quarantine authorities to apply for inspection and quarantine. Customs will, based on the Entry-Exit Inspection and Quarantine Health Certificate issuyed by the entry-exit inspection and quarantine aujthorities, release the goods.

for Rick_Zai: China import duty of edible birds nest classified under HS 04100010 has been eliminated for imports from most members of the ASEAN including the mentioned countries under the auspice of the China and ASEAN Free Trade Agreement. In order for the shipment of birdsnest to enter China mainland duty free valid Country of Origin Certificate fulfilling the origin criteria must be provided. The VAT 17% will remain to be applied.
